A company\u2019s\nvalue is directly proportional to the success of its design. <\/li>\n\n\n\n<li>It adds substantial marketing value to a\nproduct as it makes the product attractive and appealing to consumers.<\/li>\n\n\n\n<li>Lastly, the exclusivity offered by a\nregistered design right enables an owner to license the design to others to use\nfor a fee, or to assign or sell the design right to others.<\/li>\n<\/ul>\n\n\n\n<p>So\nfar, several design infringement cases have been filed around the world. Some\nof the famous ones are mentioned below.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Apple vs. Samsung Design<\/strong> (Lawsuit\nClosed)<\/li>\n<\/ul>\n\n\n\n<p>Since 2011, the companies Apple and Samsung have had <strong><a href=\"https:\/\/sagaciousresearch.com\/india-ip-litigation-support\">litigations <\/a><\/strong>over the designs and functionality of their tablets and smartphones. Samsung was recently hit with USD399 million <a href=\"https:\/\/www.cnet.com\/news\/apple-and-samsung-finally-settle-their-patent-dispute\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">penalty<\/a> for infringing on Apple\u2019s designs. Notably, the design patent at issue are&nbsp;<strong>D618677<\/strong>&nbsp;(a black rectangle with rounded corners),&nbsp;<strong>D593087<\/strong>&nbsp;(bezel on surrounding rim) and&nbsp;<strong>D604305<\/strong>&nbsp;(colorful grid of 16 icons). <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Nike vs.\nWalmart<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Nike has filed a lawsuit against Walmart for allegedly <a href=\"https:\/\/www.ipwatchdog.com\/2008\/10\/16\/nike-sues-walmart-on-design-patents\/id=217\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">infringing<\/a> on their design patents. The infringed patents include the <a href=\"https:\/\/patents.google.com\/patent\/USD498914?oq=d498%2c914\" target=\"_blank\" rel=\"noreferrer noopener\">US Design Patent&nbsp;number <strong>D498914<\/strong><\/a>&nbsp;and&nbsp;<strong>D499248<\/strong>. These design patents share the same title &#8211; \u201cPortion of a shoe midsole\u201d. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Enforce_Industrial_Design_Patents_Rights\"><\/span>Enforce Industrial Design Patents Rights<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Essentially, the owner of a registered industrial design holds the right to prevent third parties from producing, selling or importing articles displaying a design which is a replica of the protected design. In most countries, under the industrial design law, an <a href=\"https:\/\/www.wipo.int\/designs\/en\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">industrial design<\/a> needs to be registered to be protected as a \u201cregistered design\u201d. In some countries, industrial designs are protected as \u201cdesign patents\u201d. However, in few countries, industrial design laws grant protection without registration and are called \u201cunregistered industrial designs\u201d. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_can_be_Registered_as_an_Industrial_Design\"><\/span>What can be Registered as an Industrial Design?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To be eligible for registration, an\nindustrial design must meet one or more of the following requirements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It must fit the definition of a design under\nthe applicable law. For instance, a logo may not be registered as a design in\ncertain jurisdictions since it is not considered a product.<\/li>\n\n\n\n<li>The design should be novel. A design is\nconsidered novel if no identical design has been made available to the public\nprior. <\/li>\n\n\n\n<li>The design should be original. In\ncase of suspected infringement, design owners are advised to <strong>seek legal advice<\/strong>.\nFurthermore, the first action should be drafting a \u201c<strong>cease and desist<\/strong> <strong>letter<\/strong>\u201d\nto inform the alleged infringing party of a possible conflict between the two\ndesigns. Though the right owner should be sure that their design rights are valid,\nand infringement can be proved as in many jurisdictions the alleged infringing\nparty may bring an action against baseless threats of enforcement proceedings. If\nthe infringement continues after the \u201ccease and desist letter\u201d, a <strong>legal\naction<\/strong> must be taken. Numerous measures are available including \u201c<strong>surprise\naction<\/strong>\u201d by obtaining a search and seize order to conduct a raid, without\nprior notice to the alleged infringer.<\/p>\n\n\n\n<p>Generally, to protect the value of a\nregistered design, it is crucial to also <strong>regularly monitor the registration\nof designs<\/strong> to make sure that no third party is attempting to register an\nidentical\/similar design. The duration of protection of an industrial\ndesign varies from country to country, but it lasts for at least 10 years.
