IP monetization involves harnessing intellectual property assets such as patents, copyrights, and trademarks to generate revenue streams. Among these assets, companies frequently leverage patents to generate income. Notably, companies can monetize patents through two primary channels: sales and licensing. In a patent sale, companies transfer ownership rights to a buyer for a negotiated sum. Conversely, in IP licensing, owners retain ownership but grant permission to use the patents in exchange for royalty payments tied to product sales.
Macro-Level Analysis – A Novel Approach by Sagacious IP
At Sagacious IP, we’ve developed an innovative approach known as macro-level analysis. This innovative method focuses on conducting a meticulous assessment of a subset of patents within a client’s portfolio, providing invaluable insights into potential assets.
Here’s how it works:
- Automated Ranking: Initially, we employ an automated ranking process to identify the top 250 best-performing patents within a larger pool of 1000 patents.
- T-Ranking: Following automated ranking, our T-Ranking methodology swiftly screens patent titles, abstracts, and claims (TAC), classifying them as T1, T2, or T3 based on relevance and potential infringement risks. This step refines the list to approximately 50 T1-ranked patents.
- Detailed Analysis: For the T1-ranked patents, we delve into a detailed (micro-level) analysis to assess their infringement potential by examining product searches. Based on this analysis, we classify patents as high (H), medium (M), or low (L) in terms of infringement risk.
By combining automated ranking and T-ranking, we efficiently reduce the initial pool of 1000 patents to nearly 50, consequently saving valuable time and resources.
Case Study: A Fortune 100 Client’s IP Monetization Journey Through IP Licensing
A Fortune 100 client approached Sagacious IP with a custom project. Their goal was to monetize their IP portfolio through licensing in the payment domain. They were keen to license their portfolio to some companies. The client believed licensing as a good opportunity to monetize their IP portfolio against these companies, as they neither directly competed with the client nor posed any potential for counter assertion.
Employing our macro-level approach, we conducted T-ranking to identify patents relevant to target companies. Subsequently, through detailed analysis, we pinpointed mappable patents—those suitable for generating detailed charts and patents on which we could generate high-level charts. We believe that for a good licensing program one should have around six to eight detailed charts (EoU charts) against a company.
Upon assessment, we found that the client’s portfolio lacked the requisite strength for a successful licensing program with the identified companies. Consequently, the client chose to discontinue the licensing program targeting payment companies and instead shifted their focus to alternative licensing programs. As a result, they explored options such as Security & Content Delivery Networks, based on our recommendations. This strategic pivot allowed the client to derive greater value from their patent portfolio.
